What Is
Adjustment of Status?

Adjustment of Status (AOS) is the process that allows eligible foreign nationals already present in the United States to apply for lawful permanent residency — a green card — without having to return to their home country for consular processing. It is filed using Form I-485, Application to Register Permanent Residence or Adjust Status.

AOS is available to applicants who have a qualifying basis (family-based, employment-based, refugee or asylee status, and several other categories), who are physically present in the U.S., and who meet the admissibility requirements. The advantages are significant: applicants can remain in the country throughout processing, apply for a work permit (EAD) and advance parole for travel, and in many cases file concurrently with the underlying petition.

Eligibility Requirements

Who Can File
for Adjustment

Adjustment of status has specific eligibility and admissibility requirements. Every I-485 case needs to satisfy the following core conditions.

Physical Presence in the U.S.

The applicant must be physically present in the United States at the time of filing Form I-485.

Approved or Concurrent Petition

An approved or simultaneously filed I-130 (family), I-140 (employment), or other qualifying immigrant petition.

Visa Number Immediately Available

An immigrant visa must be available per the Department of State Visa Bulletin at the time of filing.

Lawful Entry & Inspection

Most applicants must have been inspected and admitted or paroled into the United States at entry.

Maintained Status (Where Required)

Employment-based and certain other applicants must generally have maintained lawful status throughout their stay.

Admissibility

No disqualifying grounds of inadmissibility — including certain criminal, immigration, or health issues.

Medical Examination (I-693)

A sealed medical examination completed by a USCIS-designated civil surgeon.

Affidavit of Support (If Required)

Form I-864 showing adequate financial support for family-based and certain other categories.
