What Is the
EB-1 Visa?

The EB-1 is the first preference category of U.S. employment-based permanent residency. Reserved for individuals whose accomplishments place them among the best in their field, it is widely regarded as one of the most respected — and one of the fastest — immigration pathways available.

Unlike most employment-based categories, EB-1 applicants are generally not required to go through PERM labor certification, and in several cases no sponsoring employer is needed at all. This makes EB-1 the pathway of choice for extraordinary individuals, outstanding professors and researchers, and multinational executives relocating to the United States.

Extraordinary
Ability

For individuals with sustained national or international acclaim in the sciences, arts, education, business, or athletics. No employer sponsorship required — applicants may self-petition.

Eligibility Criteria

The Ten EB-1A
Evidentiary Criteria

EB-1A applicants generally need to satisfy at least three of the following ten criteria — or demonstrate a one-time major achievement such as a Nobel Prize or Oscar.

Nationally or Internationally Recognized Awards

Receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field.

Membership in Distinguished Associations

Membership in associations that require outstanding achievements from their members, judged by experts.

Published Material About You

Published material in professional or major trade publications or major media about you and your work.

Judging the Work of Others

Participation — individually or on a panel — as a judge of the work of others in the same or related field.

Original Contributions of Major Significance

Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of significance.

Authorship of Scholarly Articles

Authorship of scholarly articles in professional or major trade publications or other major media.

Artistic Exhibitions or Showcases

Display of your work at artistic exhibitions or showcases in recognized institutions or venues.

A leading or critical role in distinguished organizations with a strong reputation in your field.

High Salary or Remuneration

Evidence of a high salary or remuneration relative to others in the same field, supported by comparable data.

Commercial successes in the performing arts, as shown by box office receipts, sales, or comparable metrics.
