The EB-2 is the second preference category of U.S. employment-based permanent residency. It is designed for professionals holding advanced degrees, individuals with exceptional ability in the sciences, arts, or business, and those whose work provides substantial benefit to the United States through the National Interest Waiver (NIW).
Most EB-2 applicants require a U.S. employer sponsor and PERM labor certification, but the National Interest Waiver allows qualifying applicants to bypass both — making EB-2 NIW one of the most flexible employment-based pathways available. EB-2 eligibility is defined across advanced-degree qualifications, six exceptional-ability criteria, and the three NIW prongs from the Matter of Dhanasar decision.
A U.S. master's or higher, or a foreign equivalent, directly relevant to the offered position.
A U.S. bachelor's degree followed by at least five years of progressive post-degree work experience in the specialty.
Exceptional-ability evidence: a degree, diploma, certificate, or similar award from a recognized institution.
Documented full-time professional experience of at least ten years in your field, supported by employer letters.
A license to practice your profession or certification for a specific occupation or profession.

On balance, it would benefit the United States to waive the job-offer and PERM requirements.
